Acceptable Use Policy

Rules and guidelines defining acceptable use of XeroHost infrastructure and services.

1. Introduction

This Acceptable Use Policy ("AUP") defines the rules and guidelines for using all services provided by XeroGroup LLC (operating as XeroHost). This policy applies to all customers, resellers, and end-users who access our infrastructure.

By using our services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your services without refund, and may be reported to appropriate law enforcement authorities.

This AUP supplements our Terms of Service, Master Services Agreement, and all other applicable policies.

2. Prohibited Content

The following content is strictly prohibited on all XeroHost services:

2.1 Illegal Content:Child Sexual Abuse Material (CSAM): Immediate termination and report to NCMEC and law enforcement. Zero tolerance — no exceptions. • Content promoting terrorism, violent extremism, or radicalization. • Content facilitating human trafficking or exploitation. • Illegal drug manufacturing instructions or sales platforms. • Content violating applicable local, state, federal, or international law.

2.2 Malicious Content: • Malware, ransomware, spyware, keyloggers, trojans, or any malicious software. • Phishing pages, credential harvesting sites, or social engineering traps. • Exploit kits, vulnerability scanners (targeting third parties), or hacking tools used offensively. • Botnets, Command & Control (C2) servers, or malware distribution infrastructure.

2.3 Fraudulent Content: • Pyramid schemes, Ponzi schemes, or multi-level marketing scams. • Carding services, stolen data sales, or credential dumps. • Counterfeit goods or fraudulent services. • Impersonation of other businesses, organizations, or individuals.

2.4 Adult Content: • Pornographic or sexually explicit material. • Adult content streaming or distribution. • Escort services or adult dating platforms.

2.5 Copyrighted Content: • Unauthorized distribution of copyrighted material (movies, music, software, games). • IPTV or streaming services without proper licensing. • Cracked/pirated software distribution. • Warez sites or crack repositories.

3. Prohibited Activities

3.1 Network Abuse: • Launching or facilitating DDoS/DoS attacks against any target. • Port scanning, network probing, or penetration testing against third-party systems without explicit written authorization. • IP spoofing or packet manipulation. • Operating open mail relays or open DNS resolvers that can be exploited for amplification attacks. • Sending unsolicited bulk email (spam) from our network.

3.2 Resource Abuse: • Cryptocurrency mining on shared infrastructure (VPS/Dedicated exceptions apply per plan). • Operating public proxies, VPNs, or anonymizing services (TOR exit nodes). • Web scraping or data harvesting bots at scale without target authorization. • Mass file processing (batch video conversion, automated compression) on shared plans.

3.3 Security Violations: • Unauthorized access or attempted access to other customers' data or services. • Interference with other customers' use of services. • Reverse engineering, decompiling, or attempting to extract source code from XeroHost proprietary software. • Circumventing security measures, authentication systems, or access controls.

3.4 Reseller Obligations: If you use XeroHost services to provide hosting to third parties (reselling), you are responsible for: • Ensuring your end-users comply with this AUP. • Promptly addressing abuse reports related to your end-users. • Maintaining records of end-user identity for abuse investigation purposes.

4. DMCA and Copyright Policy

4.1 DMCA Compliance: XeroHost complies with the Digital Millennium Copyright Act (DMCA). We respond promptly to valid takedown notices.

4.2 Takedown Procedure: Upon receipt of a valid DMCA notice: • First Offense: Content removed and customer notified with 24 hours to acknowledge. • Second Offense: Temporary service suspension pending resolution. • Third Offense: Permanent termination of the service.

4.3 Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification including: • Identification of the removed content and its location. • A statement under penalty of perjury that the removal was a mistake. • Your name, address, phone number, and signature.

4.4 Filing a DMCA Notice: DMCA notices must be sent via support ticket at billing.xerohost.net with the subject "DMCA Notice" and must include: • Description of the copyrighted work. • Exact URL or location of the allegedly infringing content. • Proof of copyright ownership. • Your contact information and signature.

5. Reporting Abuse

5.1 How to Report: If you have identified content or activities on our network that violate this AUP, please report it by: • Submitting a support ticket at billing.xerohost.net with "Abuse Report" in the subject. • Including as much detail as possible: IP addresses, URLs, timestamps, screenshots, and logs.

5.2 Response Timeline:CSAM Reports: Immediate action (within 1 hour) and law enforcement notification. • Imminent Threat (Active Attacks): Action within 4 hours. • Copyright Violations: Action within 24 hours. • Other AUP Violations: Action within 48 hours.

5.3 Reporter Protection: Reports are handled confidentially. We will not disclose the identity of reporters to the accused party unless required by law.

6. Enforcement

6.1 Investigation: XeroHost reserves the right to investigate suspected AUP violations. This may include reviewing server logs, network traffic patterns, and content hosted on our infrastructure.

6.2 Actions: Depending on severity, XeroHost may: • Issue a formal warning with a deadline to remediate. • Throttle or restrict specific resources or network access. • Suspend the service pending investigation. • Terminate the service immediately without refund. • Report criminal activity to appropriate law enforcement agencies.

6.3 Cooperation with Law Enforcement: XeroHost cooperates with law enforcement agencies and may disclose customer information when: • Required by a valid court order, subpoena, or legal process. • Necessary to prevent imminent harm to individuals. • Required for investigation of criminal activity hosted on our infrastructure.

6.4 No Liability: XeroHost shall not be liable for any damages resulting from enforcement actions taken under this AUP, provided such actions were taken in good faith.
